Poland hosts the largest Ukrainian diaspora in the EU: more than 1.5 million Ukrainians, including over 950,000 with temporary protection (UKR status). It is also the closest labor, education, and business market to Ukraine. Polish law has rapidly adapted to the needs of Ukrainians: PESEL UKR, simplified labor market access, and business support programs.

Zahist Law Firm assists Ukrainians in Poland across all legal matters. Our lawyers in Krakow, Warsaw, and Wroclaw work in Polish, Ukrainian, and English; they are familiar with the Ustawa o cudzoziemcach, Kodeks rodzinny, Kodeks pracy, and Kodeks spółek handlowych — and they are equally fluent in Ukrainian legislation.

Immigration law in Poland

From UKR status to Karta Pobytu Stałego

Most Ukrainians in Poland hold temporary protection (UKR), which has been extended through 2026. It is already worth planning the transition to a Karta Pobytu Czasowego or Stałego, applying for the Karta Polaka, or pursuing citizenship.

  • Extending temporary protection, UKR status, PESEL UKR
  • Karta Pobytu Czasowego (temporary residence) — based on employment, study, business, or family
  • Karta Pobytu Stałego (permanent residence) after 5 years
  • Obtaining the Karta Polaka for individuals of Polish descent
  • Naturalization — Polish citizenship
  • Family reunification (połączenie z rodziną)
  • EU Blue Card for highly qualified professionals
  • Appealing Urząd Wojewódzki refusals to issue a residence permit
  • Lifting an entry ban (zakaz wjazdu)
  • Changing residence status without leaving Poland
02

Family matters between Ukraine and Poland

Polish family law (Kodeks rodzinny i opiekuńczy) has its own characteristics: divorce always proceeds through the courts, mediation is mandatory for couples with children, and the rules on child support are clearly defined. EU Regulations apply additionally for international families.

  • Divorce from a Ukrainian spouse
  • Divorce from a Polish citizen or a citizen of another EU country
  • Divorce without the consent of the second spouse
  • Cross-border collection of child support
  • Division of property between Ukraine and Poland
  • Recognition of a Ukrainian divorce in Poland
  • Marriage between a Ukrainian and a Polish citizen
  • Parental authority (władza rodzicielska), visitation schedules (kontakty z dzieckiem)
  • Court permission to leave Ukraine with a child without the consent of the second parent
  • Response to child abduction under the Hague Convention
  • Establishing or contesting paternity
  • Adoption of a child from Ukraine by residents of Poland
03

Labor law

Protecting employees in the Polish market

Poles and Ukrainians in Poland are governed by the Kodeks pracy. Distinguishing features include strict rules for the umowa o pracę, a range of specialized contracts (umowa zlecenia, umowa o dzieło) with different tax consequences, anti-mobbing legislation, and entitlements to urlop and L4.

  • Reviewing and translating an employment contract before signing
  • Challenging unlawful dismissal
  • Recovery of unpaid wages
  • Disputes over umowa zlecenia and umowa o dzieło
  • Protection from mobbing and discrimination
  • Compensation for workplace injuries
  • Issues relating to urlop wypoczynkowy and L4
  • Preserving residence status when changing employers
  • Transitioning from umowa o pracę to JDG (sole proprietorship)

  • Registration of a JDG (sole proprietorship)
  • Business residence permit through Sp. z o.o. or JDG

  • Registration of IT startups and B2B structures
05

Real estate, criminal cases, inheritance

Poland gives Ukrainians access to real estate without restrictions for EU citizens, with certain limitations for third-country nationals (an MSWiA permit is required for some property types).

  • Real estate: purchases of apartments and houses, księga wieczysta checks, notarial transactions, landlord disputes
  • MSWiA permits for real estate purchases by third-country nationals
  • Criminal cases: defense in criminal proceedings, challenging fines, road accidents
  • Inheritance: handling Ukrainian inheritance for those living in Poland, the European Certificate of Succession, wills
  • Financial law: credit cases, challenging bank actions, personal bankruptcy
